blog stories galleries links sony moves from psn to sen, and introduces a new license saturday, november 09, 2013 by glen davies 0 comments i'm guessing this is for the run-up to the ps4 release, as it mentions sharing, but today i logged on to the psn and was presented with a new agreement before i could continue; after the otheros fiasco, yes i used it, of sony i can't help but feel a little bit nervous whenever i'm presented with a new terms of service or software usage to agree to. terms of service 2. additional terms that apply these additional documents are accessible at: eu.playstation.com/legal. this means that you have to agree to: (i) the psn and sen privacy policy (ii) the software usage terms (if you are using playstation® game and application software) (iii) the system software licence for the playstation® system you are using (if any) which have their own little issues (i'll point out an interesting one at the end of the post). 14. intellectual property rights (including pirated software) you may have the opportunity to share with us and other users your text, pictures, voice, music, video and game-related information and other materials through the sen. where you create or share material using our services (e.g. video unlimited and music unlimited), you agree that you: (i) grant us the right to: a. use, distribute, copy, modify, display and publish your material and your online id and, if you choose to display it, your name; and b. licence, sell and otherwise commercially exploit your material (for example, selling subscriptions to access your material and/or receiving advertising revenue); and c. remove and/or delete, or refuse to upload, your material at our sole discretion. (ii) we reserve the right in our sole discretion to monitor and record (or engage a third party to monitor or record) any or all of your activity and to remove any materials that you share at our sole discretion, without further notice to you. this may include information such as the content of your voice and text communications, video of your gameplay, the time and location of your activities, and your name, your psn online id and ip address. we may also receive information about your activity on the sen from other users. any information collected in this way, may be used by us or our affiliated companies to enforce these terms of service, to comply with the law, to protect our rights and those of our licensors and users, and to protect the personal safety of our employees and users. this information may be passed to the police or other appropriate authorities. please note that we cannot monitor all sen activity and we make no commitment to do so. which also mentions they will be watching you - not all of you all the time maybe, but maybe now that they will be charging for the multiplayer feature of psn they can buy some more servers and do something about that. 16. software updates and how these may affect you you agree that we can automatically upload updates to your sony system when you connect your system to the internet and/or sign into your sen account to ensure that your system is function properly in accordance with these terms of service. you agree that these updates may: (i) update your sony system’s operating system and change or remove certain features. (ii) cause loss of data, and to ensure such loss is not permanent you should archive any personal photos, music, video or other data stored on your sony system. so the updates, on top of causing data loss, can change or remove features (like they did with otheros). the important part of these automatic updates that you will allow that can remove features is found in a later clause: 19. failure to comply with these terms of service (including banning your sen account) ... (i) upload updates to your sony system intended to discontinue unauthorised use; notice the wording of this point (unlike the other 7 points) doesn't mention the sen service so can apply to the disabling of the system. no more playstation for you. now for that interesting additional term i stumbled upon, which the above forces you to agree with: software usage terms 7. resale 7.1. you must not resell either disc-based software or software downloads, unless expressly authorised by us and, if the publisher is another company, additionally by the publisher. so this means that even if sony, as they did at their big reveal, say they will allow you to trade your games the publisher (say ea for example) say they don't want you to, and according to someone in the biz they know who used what discs when, tou are still in breach of this clause. now before the sony haters (of which i have slowly become one) and xbox fanboys (i have yet to become one) tell me they've known sony are evil and microsoft are the best (which they aren't, they've done their fair share of evil) i still need to read the microsoft agreements and see if they are any better for my next console. as it is i haven't accepted these and so am off the psn. update 09/11/2013 for much better coverage of this issue, and other ps4/sony issues, i would head over to ign: http://uk.ign.com/articles/2013/11/12/ps4-sony-updates-psn-terms-of-service mcm london expo / october comic con - when security trumps reason friday, october 25, 2013 by glen davies 0 comments so, as i have every may and october since about 2007 and possibly before, i attended the mcm london expo (now mcm comic con) for october 2013. i approached the ticket scanning area with my friends on friday, early entry weekend ticket in hand and promptly received a nice black wristband with the word "weekend" on it before being ushered over to the official "wristband fitters" for want of a better term. i understand why they have them, you need someone to put it on tight enough so that it can't be removed and handed to someone else. i was greeted by an elderly woman who clearly didn't want to be there, who put it on my wrist - a little too tightly for my liking; which i made known by asking for one extra hole up the band to be used. that's right, one whole hole - the nerve. i was promptly told no. this extra hole would not have made it removable, unless i learnt to dislocate my thumb but then no amount of tightness would be safe. i let her know that this extra space had been given, and appreciated, at every other visit to the mcm expo, but alas the clasp was clicked shut where it stood. i did let her know that if it was tight enough to irritate i would have to remove it at some point - and this was the first time i ever heard that "removal voids admittance to the whole event" i couldn't help but think that couldn't possibly be the case as i walked away with my friends, surely there's the sales of goods act and other such articles of law that prevent such a thing - i made a mental
